ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) are entered into by and between you (“User,” “Client,” or “you”) and Kim Rapach Coaching, The Red Heart Collective, The Work of Warriors, and any affiliated programs, retreats, events, courses, memberships, workshops, podcasts, or offerings (“Company,” “we,” “our,” or “us”).

These Terms govern your use of our website, content, digital products, courses, retreats, coaching services, memberships, events, podcasts, social media platforms, downloadable resources, and any other services offered by the Company (collectively, the “Services”).

By accessing or using this Website or purchasing any Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use this Website or purchase our Services.

You must be at least 18 years old to use this Website or participate in any Services.

CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time without notice. Your continued use of the Website or Services after changes are posted constitutes acceptance of those changes.

INTELLECTUAL PROPERTY

All content, materials, frameworks, teachings, videos, downloads, graphics, logos, branding, podcast content, retreat materials, course materials, presentations, and intellectual property on this Website are owned by the Company and protected by copyright and trademark laws.

You may not copy, reproduce, distribute, modify, republish, upload, share, teach, sell, or create derivative works from any Company materials without prior written permission.

Any unauthorized use of Company content may result in legal action.

DIGITAL PRODUCTS

The Company may offer downloadable resources, courses, memberships, templates, workshops, recordings, or other digital products (“Digital Products”) for purchase or free access.

All Digital Product purchases are final unless otherwise stated in writing.

Due to the immediate access provided to Digital Products, no refunds will be issued for Digital Products, courses, memberships, downloadable materials, or recorded content.

You may not share, reproduce, distribute, or resell Digital Products in any form.

COACHING, WORKSHOPS, AND EDUCATIONAL SERVICES

The Company provides coaching, education, nervous system education, personal development services, workshops, retreats, and speaking engagements designed to support personal and professional growth.

You acknowledge that results are not guaranteed and are dependent upon your own participation, responsibility, effort, circumstances, and implementation.

NOT THERAPY OR MEDICAL CARE

Kim Rapach Coaching, The Red Heart Collective, The Red Heart Retreat, The Work of Warriors, and all related services are educational, coaching, and personal development experiences only.

Although Kim Rapach has previous professional experience in mental health, no services provided through this Website, coaching relationship, retreat, workshop, podcast, course, membership, or event constitute psychotherapy, mental health counseling, medical treatment, diagnosis, or healthcare of any kind.

Participation in any service does not establish a therapist-client, doctor-patient, or clinical treatment relationship.

The information shared through this Website and related offerings is intended for educational and informational purposes only and should not be considered medical, psychological, financial, or legal advice.

You are solely responsible for your own physical, emotional, mental, relational, and financial well-being, decisions, actions, and results.

If you are experiencing a mental health crisis or require medical or psychological support, you agree to seek support from an appropriately licensed provider or emergency services.

PAYMENT TERMS

By purchasing any Services, you agree to pay all fees associated with your purchase.

Payment plans are a courtesy and not a subscription. By selecting a payment plan, you agree to complete all scheduled payments regardless of participation, attendance, completion, personal circumstances, or level of usage.

The Company reserves the right to suspend or terminate access to Services for failed or missed payments.

Any balances remaining unpaid after 30 days may be sent to collections, and you agree to be responsible for any associated collection fees, legal fees, or costs.

EARLY TERMINATION OF PAYMENT PLANS

If a client chooses to terminate participation in a coaching agreement, retreat payment plan, or other contracted service before all scheduled payments are completed, the client remains responsible for 50% of the remaining unpaid balance unless otherwise agreed upon in writing by the Company.

NO REFUNDS

All payments made under this Agreement are non-refundable.

Due to the time, preparation, intellectual property, scheduling availability, and access associated with coaching services, no refunds, partial refunds, reimbursements, or chargebacks will be issued for completed sessions, unused sessions, reserved coaching time, digital materials, retreats, workshops, or coaching packages unless otherwise agreed to in writing by Coach.

Client acknowledges they are purchasing access to coaching services, reserved time, expertise, educational support, and strategic guidance, not guaranteed outcomes or results.

RETREATS AND LIVE EVENTS

Participation in retreats, workshops, live events, or in-person experiences is voluntary.

You understand that participation may involve emotional discomfort, physical activity, personal reflection, interpersonal interactions, travel risks, and other unforeseeable circumstances.

You accept full responsibility for your participation and assume all associated risks.

The Company is not responsible for injury, illness, travel delays, personal property loss, emotional distress, or any damages resulting from participation in Services or Events.

RETREAT CANCELLATION POLICY

Unless otherwise stated in writing:

Retreat deposits are non-refundable.
Payments made toward retreats are non-refundable within 60 days of the retreat start date.
Transfers to future retreats or services are at the sole discretion of the Company.
If the Company cancels a retreat or event, liability is limited to the amount paid directly to the Company for the event.

The Company is not responsible for airfare, lodging outside retreat accommodations, transportation costs, or other travel-related expenses.

PARTICIPANT RESPONSIBILITY AND COMMUNITY STANDARDS

The Company reserves the right to remove any participant from a retreat, workshop, coaching container, membership, or event if their behavior is disruptive, unsafe, abusive, threatening, inappropriate, or negatively impacts the experience of other participants or staff.

No refunds will be issued in the event of removal due to violation of these standards.

Participants understand that emotional growth work may feel uncomfortable, activating, or confronting at times. Participation is always voluntary, and participants are responsible for honoring their own physical, emotional, and psychological limits throughout the experience.

MEDIA RELEASE

By participating in any retreat, workshop, event, podcast recording, virtual session, or live experience hosted by the Company, you grant permission for photographs, videos, audio recordings, testimonials, and other media containing your likeness, voice, participation, or written feedback to be used for educational, promotional, marketing, website, podcast, and social media purposes unless otherwise agreed upon in writing prior to the event.

The Company will make reasonable efforts to respect participant privacy and dignity when using such materials.

NO GUARANTEES

The Company makes no guarantees regarding outcomes, results, earnings, emotional breakthroughs, relationship outcomes, healing outcomes, business success, or personal transformation.

Testimonials and examples shared by the Company are examples only and do not guarantee similar results.

DISCLAIMER

All Website content and Services are provided for informational and educational purposes only and are provided “as is” without warranties of any kind.

The Company disclaims all liability for decisions made based on information provided through the Website or Services.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, emotional, special, punitive, or financial damages arising from your use of the Website or participation in Services.

Your use of the Website and Services is entirely at your own risk.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its owners, affiliates, employees, contractors, volunteers, retreat staff, agents, and representatives from any claims, liabilities, damages, expenses, or legal fees arising from your use of the Website or participation in Services.

GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Illinois. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Illinois.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and the Company regarding use of the Website and Services.
